3. Duty of the business owner or employer

Business owners and employers must:

ensure that appropriate no smoking signage is displayed:

  • premises have no smoking signs placed at each entrance displayed in a prominent position
  • vehicles used for a work purpose (including voluntary work and transportation) display adequate no smoking signage

take all reasonable and practical steps to ensure that the legislation is followed in their premises and vehicles

ensure that all staff, both existing and new starters are made aware of your smokefree policy

Employers may also wish to consider the following in order to help comply with the law and create a healthier environment:

Smokefree policy

Produce a written smokefree policy and bring it to the attention of staff and visitors.

Staff training

Consider training staff to ensure they understand the legislation and what their responsibilities are.

Offer support to staff to stop smoking

Work with staff offering support and guidance to help them quit smoking altogether.
