Wolborough Barton appeal rejected

A statement from Teignbridge District Council
We welcome the clarity that comes from the Court of Appeal’s rejection of further legal efforts by Abbotskerswell Parish Council to block the development of new homes at Wolborough Barton.
In rejecting the parish council’s appeal against a previous ruling to refuse a statutory review of the planning decision, the Court has allowed the development to commence.
All arguments put forward by Abbotskerswell for a review have been rejected by the Court which concluded “there is no discernible error and no other compelling reason for an appeal to be heard. The judgment is closely reasoned and successfully applies conventional and established principles to the facts of the present case”.
This ruling finally brings to an end a process that started in 2014 and which has seen significant public funding spent reviewing this application through every possible planning and legal process.
This judgement again demonstrates that the Council acted appropriately, following the correct planning processes and gave sound professional advice on planning, ecological and environmental issues.
The development will provide homes to meet the needs of our whole community – including affordable homes and care facilities – as well as creating jobs throughout construction and through employment land delivery. It includes land for a new primary school and sites for shops, a community building, allotments, play areas and other green space. Public transport, walking and cycling connections will be improved and a new link road will ease congestion and help improve air quality.
Whatever people’s views have been in the past, we hope that everyone will now work together to make this a place where people want to live, work and play.
We will work with the developers to ensure that the detailed planning requirements are properly met and that homes, amenities and surroundings are built to meet the needs of future generations. We will prioritise delivering key infrastructure at the earliest opportunity, where possible ahead housing being built.
