4. Who can appeal a planning decision?

Only the applicant can submit an appeal. There is no third party right of appeal.

If you are not the applicant and wish to challenge the validity of a decision through the courts, you should first write to us detailing your reasons for dispute. If this does not resolve the issue, you may decide to serve an application for permission to apply for Judicial Review on us and any other interested party and lodge it at the Administrative Court Office for the High Court. This must be done within 6 weeks of the date of decision. It can be an expensive and complicated process and you are strongly advised to seek legal advice.
